1. this Indenture made the Twenty Third day of November in the Year of our Lord One Thousand Seven Hundred and Fifty two BETWEEN Peter
2. Bold of Bold in the County of Lancaster Esquire of the one part, and Edward Brookfield of North Meols in the said County of Lancaster fisherman of
3. the other part WITNESSETH that the said Peter Bold for and in Consideration of the sum of Twenty pounds of lawful money of Great
4. Britain to him in hand well and truly paid by the said Edward Brookfield at or before the Sealing and delivery of these presents, the receipt
5. whereof the said Peter Bold doth hereby Acknowledge and Confess, and there of and of every part thereof Doth herby acquitt release and discharge
6. The said Edward Brookfield his heirs Executors and Administrators and every of them, and for diverse other good Causes and valuable conseidrations him
7. therunto moving, he the said Peter Bold HATH Demised Granted sett and to farm letten and by these presents DOTH Demise Grant
8. Sett and to farm lett unto the said Edward Brookfield ALL that Messuage and Tenement with its appurtenances Situate lying and being in Banks within North Meols aforesaid consisting of a House and
9. Outhousing containing four Bays and a Down Dubb of Building, Together with the Several Closes Closures or parcells of Land thereunto belonging and hereinafter particularly mentioned
10. that is to say, the Croft, and the Three Rood Land of Ground, containing in the whole by common Estimation Two Acres Two Rood Land and Twenty two perches of Land of the measure there used
11. or thereabouts be the same more or less, and now in the possession or Occupation of the said Peter Bold his Undertenants or Assignes, Together with all and Singular Houses Outhouses Edifices
12. Buildings yards …ards garden Lands meadows pastures Common of pasture duly during the will and pleasure of the said Peter Bold his heirs and Assigns and Turbary Sufficient to be used and
13. Spent upon the premisses and not elsewhere, ways waters watercourses Dithes fences Libertys Easements property and advantages whatsoever to the said Messuage and premisses or any part
14. thereof lying belonging or in any wise appertaining or accepted reputed taken or known to be as part parcel or or Member thereof unto the said Edward Brookfield his heirs and assigns for and Assignes for and during the life and lives of the said Edward Brookfield aged thirty five years Ann his wife aged forty five
22. Years and Michael their Son aged Thirteen years and for the life of the Survivor and longest liver of them YIELDING paying doing and performing therefore yearly during the said Term unto the said Peter
23. Bold his heirs and assignes the rents Boones Suits Dutys and Services hereinafter mentioned, that is to say, the Yearly rent of Twenty Shillings of lawful money of Great Britain, clear of all parliamentory and other
24. Taxes Charges and deductions whatsoever at and upon the feast days of Penticost and Saint Martin the Bishop in Winter by even and equal portions, And also the yearly Boones of Three hens or one shilling and
25. six pence in money, and one day Boon Yearly if called on at the Election of the said Peter Bold his Heirs and Assignes AND Grinding all such Corn Grain and Malt as he the said Edward Brookfield his Heirs or
26. Assigns and under tenants of the premisses or any of them shall use or spend Ground upon the said premisses or any part thereof at all times during the said Term at the Mill or Mills of or belonging to the said
27. Peter Bold his Heirs or Assignes within the said Manor of North Meols and not elsewhere, AND also yielding performing paying and doing Suit of Court and all such other Boones dues dutys and Services as
28. heretofore have been Usually paid done or performed for or for or in respect of the said Messuage Tenement and premisses AND likewise doing observing and performing all and Singular the Covenants and
29. Agreements hereinafter in these presents mentioned by or on the part or behalf of the said Edward Brookfield his heirs or Assignes to be done observed or performed PROVIDED always that if the said Yearly rent
30. of Twenty Shillings or any part thereof shall be behind and unpaid by the Space of Twenty days next after any of the days whereon the same are respectively reserved to be paid as aforesaid
31. Or if the said Edward Brookfield his Heirs or Assignes shall fail to Yield do pay or perform any of the aforesaid Boones dues dutys Suits Customs and Services or any of the Covenants and agreements here in after in these
32. presents mentioned or contained to be observed done or performed by and on the part of the said Edward Brookfield his Heirs or Assignes, Or shall make Cause or Suffer to be made any wilful or voluntary Waste in or upon
33. the said premisses or any part thereof, Or shall Kill or destroy any Game upon the same premisses by any ways or means whatsoever, or shall Demise Grant assign sett over or Exchange the said premisses or any part
34. thereof to or with any person or persons without the Lycence and Consent of the said Peter Bold his Heirs and Assignes first had and obtained in writing
35. under his or their hand or hands, that then and from thenceforth it shall and may be lawful to and for the said Peter Bold his Heirs and Assigns unto the said Demised premisses or any part thereof in
36. the name of the whole to re=enter and the same to have again repossess and Enjoy as in his and their former Estate, Anything herein before contained to the contrary thereof in any wise not withstanding
37. PROVIDED also further and upon condition that if by any means or Occasion of any Act or thing not herein before provided against that shall be hereafter Committed or done or willingly Suffered by the said Edward Brookfield
38. his Heirs or assignes or by any of them the Extate and Interest which the said Edward Brookfield his Heirs and Assignes or any of them shall or may have by Virtue of these presents in or to the said Tenement and
39. premisses or any part thereof shall become forfeited to any other Save to the said Peter Bold his Heirs and Assignes by any manner of ways whatsoever Then this present Demise and the Term hereby Granted shall cease and be void. AND the said Edward Brookfield for himself his Heirs Executors Administrators and
41. assignes doth hereby Covenant promise Grant and agree to and with the said Peter Bold his Heirs and Assignes, That he the said Edward Brookfield his Heirs and Assignes shall and will from time to time and at all times
42. during the Term hereby Granted well and truly pay the said yearly rent of Twenty Shillings at the days and times here in before appointed for payment thereof AND also pay do and perform all and singular the Boones
43. dues dutys Suits Customs and Services hereinbefore reserved, and also well and Sufficiently repair Maintain and keep the said Demised Messuage Tenement and premisses and all the Gates Stiles Hedges Ditches Drains and
44. fences of in and upon the same in good and Tenantable repair and the same so repaired at the end or sooner Determination of the said Term shall and will peaceably and Quietly deliver and Yield up unto the said Peter Bold
45. his Heirs and assignes, AND further shall and will from time to time and at all times during the continuance of this Lease or Demise Yearly Spend lay and bestow upon the same premisses or some part thereof and not
46. elsewhere; all the Dung Soil and Compost which may or shall be gotten had or made upon the same or any part thereof AND moreover that he the said Edward Brookfield his Heirs and Assignes and under tenants
47. of the said premisses shall and will from time to time and at all times during the continuance of this Lease or Demise Grind all his and their Corn Grain and Malt which shall be spent Ground upon the said premisses or
48. any part thereof at the Mill or Mills of or belonging to the said Peter Bold his Heirs and Assignes within the said Manor and not elsewhere AND the said Peter Bold for himself his Heirs and Assignes doth hereby covenant
49. promise Grant and agree to and with the said Edward Brookfield his Heirs and assignes That he the said Edward Brookfield his Heirs and Assignes paying the Rents and Boones and performing the Services Covenants
50. Conditions and Agreements hereincontained which on his and their parts are and ought to be observed performed and kept shall and may from time to time and at all times during the Term hereby Granted
51. have hold use occupy possess and Enjoy the said Demised Messuage Tenement and premisses and every part and parcel thereof without the Disturbance hindrance or Interruption of him
52. the said Peter Bold his Heirs and Assignes or any other person or persons lawfully Claiming by from or under him them or any of them AND LASTLY the said Peter Bold hath Constituted and ordained and in
53. his stead putt and doth hereby Authorize and Impower Richard Richard Boond his true and lawful Attorney for him and in his name place and stead to enter into the said Demised Messuage Tenement and premisses or into
54. any part thereof in the name of the whole and thereof to take possession and after possession thereof so had and taken full Quiet and peaceable possession and Seizin to deliver to him the said Edward Brookfield or his
55. lawful Attorney in that behalf TO HOLD the same unto him the said Edward Brookfield his Heirs and Assignes for and during the said Term hereby Granted according to the true intent and meaning of these
56. presents IN WITNESS whereof the parties aforesaid to these presents their hands and seals have hereunto to Interchangeably sett and putt the day and Year first above written.
